Investing an Injury during Child Birth

The most widely publicised compensation cases relate to children with Cerebral Palsy arising from child birth.  Some of the documented cases of Cerebral Palsy involve:

  • Failure to carry out a Caesarean Section
  • Delay in delivery
  • Inappropriate use of forceps or vacuum extraction
  • Excessive use of Oxytocin or Syntocinon
  • Delay in resuscitation
  • Mis-management of Neo-Natal care treatment

It is important to appreciate that only a small percentage of cases involved in Cerebral Palsy arise from negligence.  In many cases the cause of the child’s disability is not established or is related to non traumatic injury. 

Investigating an issue relating to childbirth or brain injury

We aim to provide realistic advice to families.  A key part of this service is to ensure that the medical treatment is investigated thoroughly and that the family does benefit from an independent expert assessment of the standard of treatment provided at the Hospital.  Legal Aid is usually available where a case relates to a child’s disability.  The process for obtaining Legal Aid to investigate the case takes approximately 12-18 months.  It is often the case that a number of medical reports will be required to address the standard of obstetric care and also the potential cause of the child’s disability.  These reports are detailed, complex and require expert legal advice.  Our Lawyers who handle birth injury and Cerebral Palsy cases are very experienced and achieve proven results in this specialist area of law.

Recent Successful Cases

In 2009 the Managing Partner, Joe Moore resolved one of the largest Cerebral Palsy compensation cases ever undertaken in Northern Ireland.  The settlement was obtained on behalf of a child who has dyskinetic spastic quadriplegia.  The child’s injury was caused as a direct result of inappropriate use of Oxytocin during the labour and delivery.  The investigation of the case took a considerable amount of time and involved expert advice from a number of medical disciplines.  The experts were sourced from outside Northern Ireland.  The child’s family have now been able to provide suitable 24 hour care together with respite care and have purchased a state of the art property for the child’s long term care.
